These Terms of Service (“Terms”) are an agreement between you and Joshua Taniwha, an individual doing business as GiftMwah, based in Connecticut, United States (“GiftMwah”, “we”, “us”). They govern your use of https://giftmwah.com and any related services (the “Service”). By using the Service you agree to these Terms. If you don’t agree, please don’t use the Service.
1. What the Service is
GiftMwah lets you create gift lists, share them with friends and family, discover gift ideas, and follow links to third-party retailers to buy them. We don’t sell products ourselves. When you click through to a retailer, your purchase is with that retailer under their terms.
2. Affiliate links and how we make money
As an Amazon Associate we earn from qualifying purchases. We also participate in other affiliate programs (for example CJ, Awin, Rakuten, and link-monetization services). When you buy through a link on the Service, the retailer may pay us a commission. This does not change the price you pay. Our recommendations are editorial; commission does not decide what we show, though it may affect ordering among otherwise similar items. See our affiliate disclosure.
3. Prices, availability and product information
Prices, availability, images and descriptions are provided by retailers or by users who paste links, and can change at any moment. We show the time a price was last checked, but the price on the retailer’s site at checkout is the one that applies. We are not responsible for errors in third-party product data.
4. Accounts
You can browse and start a list without an account. To save lists across devices, share them, or connect with friends you need to sign in with Google or an email link. You must be at least 13 years old. You’re responsible for activity under your account and for keeping your sign-in email secure. We may suspend or delete accounts that violate these Terms.
5. Your content
You own the lists, notes, names and links you add (“Your Content”). You give us a worldwide, non-exclusive, royalty-free license to host, display, and share Your Content as needed to run the Service — for example showing a public list to visitors, or showing a friends-only list to your friends. Product links you paste may be stored in our catalog and shown to other users as gift ideas, without your notes or name attached.
You agree not to add content that is unlawful, infringing, hateful, sexually explicit, deceptive, or that links to malware or phishing. We may remove content or lists at our discretion.
6. Sharing, friends and claiming gifts
You control who can see each list (just you, friends, anyone with the link, or public). Anyone who can see a wishlist may mark an item as claimed and enter a name; we don’t verify those names. Claims are a courtesy to avoid duplicate gifts, not a reservation with any retailer. If you make a list public it may be indexed by search engines and embedded on other websites.
7. Acceptable use
Don’t scrape, spam, probe, or overload the Service; don’t use it to harass anyone; don’t attempt to access other people’s private lists or accounts; don’t misrepresent yourself when accepting invitations or claiming gifts; and don’t use the Service to violate any law or any retailer’s or affiliate program’s terms.
8. Intellectual property
The Service, its design, code, and editorial content are ours or our licensors’ and protected by copyright and other laws. Retailer names, product names and images belong to their owners and are shown for identification only.
9. Third-party sites
Links lead to sites we don’t control. Their content, privacy practices and terms are their own. Buying through them is at your own risk.
10. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don’t warrant that the Service will be uninterrupted, error-free, or that product information is accurate.
11. Limitation of liability
To the fullest extent permitted by law, Joshua Taniwha and its owners, employees and partners will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, data or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of US$50 or the amount you paid us in the twelve months before the claim (which, for a free service, is zero). Some jurisdictions don’t allow these limits, so they may not apply to you.
12. Indemnity
You’ll defend and indemnify us against claims arising from Your Content or your breach of these Terms.
13. Termination
You can delete your lists at any time and request account deletion by emailing support@giftmwah.com. We may suspend or end the Service, or your access to it, at any time, with or without notice.
14. Changes
We may update these Terms. We’ll change the date at the top and, for material changes, show a notice on the Service or email account holders. Continued use after changes means you accept them.
15. Governing law and disputes
These Terms are governed by the laws of the State of Connecticut, United States, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Connecticut, and you consent to their jurisdiction. Nothing here limits consumer rights you have under the law of where you live.
